Between Rhetoric and Reality: When the Government Between Rhetoric and Reality: When the Government Invites Investment but @migraciones_ar Drives Away Migrants with capital. 

Argentina’s Government has made attracting investment a national priority. President Javier Milei and Economy Minister Luis Caputo @mineconomia_ar have repeatedly called for more foreign capital, while Decree 366/2025 seeks to encourage high-quality immigration, including investors, retirees, pensioners, and financially independent migrants.

Yet, in practice, many applicants experience the exact opposite.

In some regional offices of the National Immigration Directorate—particularly the Salta Delegation—applications are delayed by excessive formalities, repetitive document requests, restrictive legal interpretations, and unnecessary bureaucratic obstacles.

Applicants who meet every legal requirement often wait 9 to 12 months for residence permits valid for only 12 months, meaning that by the time they receive their DNI, much of its validity has already expired. Others are expected to remain at home indefinitely waiting for unannounced inspections or comply with arbitrary administrative requirements that add nothing to legal certainty.

These are retirees, pensioners, investors, and passive-income earners who bring foreign currency, purchase property, consume locally, and contribute to Argentina’s economy.

There are reasons for optimism. Minister Federico Sturzenegger @sturzenegger.federico has led an ambitious effort to modernize the State, reduce bureaucracy, and simplify administrative procedures. Hopefully, that same reformist vision will soon reach immigration administration @migraciones_ar 

If Argentina truly wants to compete with countries such as Portugal, Uruguay, Panama, and Paraguay for global investors and financially independent migrants, immigration policy and immigration practice must move in the same direction.

Otherwise, the message remains contradictory:

The Government invites investment. The bureaucracy drives it away.
⚖️ 🇦🇷 Left Argentina during the last 2 y ⚖️ 🇦🇷 Left Argentina during the last 2 years? You may still be eligible for Argentine citizenship.

When Decree 366/2025 came into effect, it imposed an extremely restrictive rule: any absence from Argentina during the previous two years—even for a single day—could prevent you from applying for citizenship.

That is no longer the legal landscape.

The Federal Civil and Commercial Court of Appeals has declared those provisions of Decree 366/2025 unconstitutional, reaffirming that reasonable, temporary absences—such as travel for tourism, business, or family reasons—do not automatically prevent you from pursuing Argentine citizenship through the courts.

If you postponed your citizenship application because you thought a short trip abroad had disqualified you, it may be time to reconsider your options, there is a new window of opportunity after this new precedent.
